| As foreigners can not obtain a freehold title (Hak Milik) for land property in Bali, the name of the Indonesian 'nominee' has to go on the mortgage application and this is why Indonesian banks have been reluctant to give mortgages. However, the introduction of 'right of use above freehold land' (Hak Pakai Atas Hak Milik) is a way for foreigners living in Indonesia to have their name on the title deed and hence make it easier to get a mortgage. Hak Pakai (right of use) is a certificate which is valid for 25 years and renewable three times, effectively giving the purchaser 100 years.
